The Tile Vault – Terms of Service

The term "Customer" refers to any person, business, or entity purchasing materials from The Tile Vault and agreeing to the following Terms and Conditions of Sale:

1. General Terms

No Warranties or Liabilities: The Tile Vault makes no express or implied warranties beyond those stated in this agreement. We are not liable for direct, indirect, special, or consequential damages arising from the purchase, use, installation, or resale of our materials.
Limitation of Liability: Our liability is limited to replacement of defective materials or, at our discretion, a refund equal to the sale price of the defective materials.

2. Product Conditions & Returns

Inspection & Acceptance: Customers must inspect materials upon receipt. By accepting and removing materials from our premises, the customer acknowledges they are in satisfactory condition.
Final Sale on Clearance & Special Orders: Clearance products, items with codes ending in -FS, and special orders are sold as-is and cannot be returned.
Return Eligibility: Returns are accepted within 14 days of purchase if:
✅ The product is unused, undamaged, and in original packaging.
✅ The customer provides a valid sales receipt.
Special Order Cancellations:
- Canceled within 6 hours → Full Refund.
- Canceled after 6 hours → 30% restocking fee applies (deducted from the refund).

3. Ordering & Availability

Stock & Availability: The Tile Vault does not guarantee the availability of materials at any given time. Orders may be canceled or delayed due to supply constraints.
Customer Measurements: The customer is responsible for providing accurate measurements and should ensure they have enough material before installation begins.
Price Changes: Prices are subject to change without notice. The final purchase price is determined at the time of sale.

4. Payment & Security

Payment Authorization: By providing a credit card, the customer authorizes The Tile Vault to charge the agreed amount.
No Chargeback Policy: Customers agree not to dispute charges related to the quality or condition of materials if the amount does not exceed the outstanding balance.
Ownership & Security Interest: Materials remain the property of The Tile Vault until full payment is received. If unpaid, The Tile Vault retains a security interest in the materials and may take necessary legal action to recover costs.

5. Pickup, Storage & Shipping

Pickup Responsibility: Orders are prepared at our warehouse loading area. Our employees are not responsible for loading materials onto customer vehicles.
Unclaimed Materials: Paid materials must be picked up within 7 days of purchase. After that, a storage fee of $5 per pallet per day will apply. Unclaimed materials left for over three months may be disposed of per provincial regulations.
Third-Party Shipping: Shipping within the Greater Toronto Area (GTA) is available via a third-party carrier at the customer’s expense. The Tile Vault is not responsible for any damage that occurs during shipping.

6. Governing Law & Disputes

Jurisdiction: All disputes shall be governed by the laws of the Province of Ontario.
Severability: If any clause in this agreement is deemed invalid, the remaining terms will remain in full effect.

7. Final Sale & Refund Policy

All Sales Are Final, except where explicitly stated in our Return Policy.
